1. AGREEMENT TO TERMS
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and Artifishare.com ("Artifishare," "we," or "us") governing your access to and use of the Artifishare website (the "Site") and related services, including:
- Customizing home textile products using pre-designed patterns, Al-generated designs (via Midjourney API), or User-uploaded designs.
- Earning commissions through shared designs.
- Ordering digitally printed products manufactured in China and other countries and shipped globally.
By accessing the Site or using our services, you agree to comply with these Terms. If you disagree, discontinue use immediately.
Updates: We may modify these Terms at any time. Continued use after changes constitutes acceptance.
2. INTELLECTUAL PROPERTY
- Our Content: The Site, its logos, and non-user-generated content (e.g., default patterns) are Artifishare's property. Unauthorized commercial use is prohibited.
- Your Designs:
- Uploaded Designs: You retain ownership but grant Artifishare a non-exclusive, royalty-free license to reproduce, display, and sell products featuring your designs.
- AI-Generated Designs: Subject to Midjourney's [Terms of Service](https://midjourney.com/terms).
- Commissioned Designs: Shared designs may be modified by other Users; original creators earn commissions per Section 5
3. USER REPRESENTATIONS
You warrant that:
- You are ≥18 years old.
- Uploaded designs do not infringe third-party rights (e.g., copyrights, trademarks).
- Al-generated designs comply with Midjourney's policies and ethical guidelines.
- You will not exploit the Site for unauthorized commercial purposes (e.g., bulk resale).
4. CUSTOMIZATION & ORDERS
- Product Accuracy: Colors/materials may vary slightly due to screen settings or fabric dyeing processes.
- Returns: Custom products are final sale unless defective (see [Return Policy](#)).
- Payment: We accept Visa, Mastercard, PayPal, and Apple Pay. Currency conversion fees may apply.
5. COMMISSION PROGRAM
- Eligibility: Earn commissions by sharing designs publicly on the Site.
- Payouts: - 4% Commission: For orders using your exact shared design (regardless of size/material changes).
- 2% Commission: For orders using Al-modified versions of your shared design.
- Withdrawals: Minimum $20 balance. Processed via PayPal/bank transfer 3-7 business days
- Fraud: Artifishare reserves the right to withhold payments for suspicious activity.
6. PROHIBITED ACTIVITIES
You may not:
- Upload designs containing hate speech, nudity, or illegal content.
- Use bots/scrapers to manipulate commissions or traffic.
- Reverse-engineer the Al design tool or Site code.
- Share designs infringing third-party IP rights.
7. USER-GENERATED CONTENT
- Liability: You are solely responsible for uploaded/Al-generated designs. Artifishare may remove content violating these Terms.
- Moderation: We reserve the right to suspend accounts for repeated violations.
8. INTERNATIONAL ORDERS & SHIPPING
- Duties: Customers are responsible for import taxes/fees.
- Delays: Artifishare is not liable for customs delays or carrier issues. Track orders via provided tracking numbers.
9. DISPUTE RESOLUTION
- Governing Law: Disputes governed by laws of [Insert Jurisdiction, e.g., State of Californial.
- Arbitration: Claims resolved through binding arbitration under [Insert Arbitration Body]. Class actions waived.
10. LIABILITY & DISCLAIMERS
- Product Use: Artifishare is not liable for damages from misuse of products (e.g., flammable materials near heat).
- Al Tools: We do not guarantee Al-generated designs will meet expectations.
- Third-Party Services: Midjourney API and shipping carriers (e.g., DHL/FedEx) operate under their own terms.
